If you open it up then you void the warranty, as you would for most electrical items, but you won't get banned from XBox Live, because they'll never know that you've done that if you don't install anything to let it to install pirate software. Its not really shocking, its part of the terms of using their online service that you pay for the games you play using that online service, Steam is the same.

Well it would be possible for them to have a tamper switch, like in alarm systems, not being that familiar with the hardware, and the screenshot just mentioning a repair...
You don't pay to play online with steam only to buy games.
